How Consortium Works

Owner-operator? You can't manage your own random pool.

FMCSA requires self-employed drivers to join a consortium. We are that consortium for hundreds of owner-operators across the country.

Common questions

DOT compliance questions, answered

What percentage of drivers must be randomly tested each year?

Under 49 CFR § 382.305(b), the minimum annual random testing rates are 50% of average driver positions for controlled substances and 10% for alcohol. FMCSA sets these rates and can raise or lower them based on the industry-wide violation rate, so they are worth re-checking each year.

Do I have to run a Clearinghouse query every year?

Yes. 49 CFR § 382.701(b) requires employers to query the FMCSA Drug and Alcohol Clearinghouse at least once per year for every driver subject to testing. That is separate from the pre-employment query under § 382.701(a), which must be a full query with the driver's specific consent and must be completed before the driver performs any safety-sensitive function.

We run both for the drivers we manage.

I'm an owner-operator. Can I run my own random pool?

Not in any workable way. The regulation permits an employer to use a service agent such as a C/TPA (§ 382.305(j)(2)) rather than requiring it — but it also requires that selections be genuinely random and that every covered driver be in the pool. A pool containing one driver cannot produce a random selection in any meaningful sense, which is why owner-operators join a consortium. Enrolling in ours puts you in a pool large enough for the selection to be valid.

Does joining a consortium make me compliant immediately?

No, and be careful with anyone who says it does. A DOT-regulated driver must have a negative pre-employment test result before performing any safety-sensitive function. Consortium enrollment covers your ongoing random testing obligation; it does not retroactively satisfy pre-employment testing, your written policy, or your Clearinghouse queries.

What does a written DOT drug and alcohol policy have to contain?

49 CFR § 382.601 requires every employer to provide educational materials explaining the requirements of Part 382 and the employer's own policies and procedures for meeting them, distributed to each driver before testing begins and to each driver hired or transferred in afterwards. Our customized policy covers that obligation.

Who needs supervisor reasonable-suspicion training?

Under 49 CFR § 382.603, every person designated to supervise CDL drivers must receive at least 60 minutes of training on alcohol misuse plus at least an additional 60 minutes on controlled substances use — 120 minutes total. The same section states plainly that recurrent training is not required, so the initial training satisfies the rule. Our Reasonable Suspicion course is $39.99.
