Owner-operators, company drivers, and carriers

Owner-operators

You are your own employer, so FMCSA requires you to designate a C/TPA for Clearinghouse reporting (49 CFR § 382.705(b)(6)). We act as your C/TPA, schedule your tests, and report your results.

Company drivers and carriers

Your employer picks the follow-up test dates (§ 40.307). We schedule and track the tests for them. The driver or the carrier can pay for the package.

Return-to-duty testing questions, answered

Do you do the SAP evaluation?

No. The SAP evaluation, education and treatment are done by an independent, DOT-qualified Substance Abuse Professional. We handle the testing that comes after. If you need a SAP, ask us for our list of DOT-qualified counselors.

When can I take the return-to-duty test?

Only after your SAP determines you have successfully complied with the education or treatment they prescribed. 49 CFR § 40.305(a) says the test cannot occur until then. You need a negative drug result and/or an alcohol result below 0.02 before going back to work.

Why do the tests have to be observed?

49 CFR § 40.67(b) requires every return-to-duty and follow-up urine collection to be directly observed. It is not optional and it is not something the donor can decline.

What if my SAP orders more than six follow-up tests?

Your SAP sets the number. It is at least six in the first 12 months and can run up to 48 more months, for drugs, alcohol or both (49 CFR § 40.307). Each test beyond the six in the package is $199.

I drive for a company. Can I still use this?

Yes, if your employer agrees. For company drivers, the employer decides the actual follow-up test dates (49 CFR § 40.307(d)(3)). We schedule the tests on the employer's behalf and keep the plan on track. Either you or your employer can pay for the package.

Do I need a job before I buy this?

The return-to-duty test has to be ordered by an employer. Owner-operators are their own employer and must designate a C/TPA for Clearinghouse reporting (49 CFR § 382.705(b)(6)), which we can be. If you are looking for work, call us and we will tell you when to start.
